1. Acceptance of Terms

By accessing or using Lustorio ("Service"), operated by LinCat, LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 18 years old to use this Service. By using Lustorio, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Description of Service

Lustorio is an AI-powered interactive fiction platform that allows users to create personalized story experiences. The Service uses artificial intelligence to generate narrative content based on user preferences and choices.

4. Account Registration

To access certain features, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

5. Subscription and Billing

Free Tier: Users may access limited features, including stories up to 12 chapters.

Premium Subscription: Available for $18/month, providing unlimited chapters and additional features. Subscriptions automatically renew unless cancelled before the renewal date.

By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel at any time through your account settings.

6. Content Policy

While Lustorio permits adult content, the following content is strictly prohibited:

  • Sexual content involving minors (anyone under 18)
  • Non-consensual sexual content
  • Extreme violence or gore
  • Content promoting self-harm or suicide
  • Bestiality or zoophilia

Violation of these policies will result in account restrictions. Three violations will result in permanent account suspension.

7. User Content and Intellectual Property

You own the stories. All AI-generated content created through your use of the Service belongs to you. You are free to share, publish, modify, or use your stories anywhere you wish, including for commercial purposes.

By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely to provide and improve the Service. This license is limited to operating the platform and does not transfer ownership of your content to us.

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to circumvent content moderation systems
  • Share your account credentials with others
  • Interfere with or disrupt the Service
  • Reverse engineer or attempt to extract source code

8. AI-Generated Content

Content generated by our AI is provided "as is." While we implement content moderation, AI-generated content may occasionally produce unexpected results. We are not liable for any AI-generated content that you find objectionable or that does not meet your expectations.

9. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by LinCat, LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without prior written consent.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or our Content Policy. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through your account settings.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINCAT, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

13. Indemnification

You agree to indemnify and hold harmless LinCat, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

14. Governing Law

These Terms shall be governed by the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in New York.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
